LEGAL BASES OF GIVEAWAY «WIN FREE GOYA EXTRA VIRGIN OLIVE OIL FOR A YEAR!»
1.- COMPANY ORGANIZING THE PROMOTION
The company Goya en España SAU with the address; Ctra. Sevilla-Malaga, Km. 5,4. Polígono Industrial “La Red Sur”, Calle 9 – Nº 1 Aptdo. 60. CP.41500 Alcalá de Guadaíra (Sevilla), España identified by the CIF number A41037904 is organizing the draw, the «Promotion» of national scope, to be performed via the Internet, exclusively for users residing in the United States in accordance with the provisions of the participation requirements section.
The purpose of this draw is to reward followers loyalty to the brand.
2.- START AND END DATES
The Promotion will start on June 10, 2019 at 20:00 Spanish time, and end on July 9, 2019 at 20:00 Spanish time.
3.- REQUIREMENTS FOR PARTICIPATION AND PROMOTION MECHANICS
The participation requirements will be the following:
- Those who reside in the United States that are over 18 years old will be able to participate.
- Only participants who are Instagram account holders can participate.
- Participants must follow the Goya Olive Oil (@Goyaoliveoil) Instagram account.
- Participants must comment on the brands’ post on the Instagram social network by tagging 2 friends during the participation period.
- Participants can only participate with a single Instagram account. If it is detected that a participant enters the draw with several Instagram accounts, they will be disqualified.
- Although participants may write several comments on the same post, they will only count as a single entry into the draw.
- The application will accumulate mentions and hashtags from the same participant, even if these are in different comments.
4.- CONDITIONS OF THE PROMOTION AND PRIZES
The winner will be chosen via the Easypromos platform at random. The winner will be contacted on July 12, 2019 at 20:00 Spanish time via the brand’s Instagram profile, along with the draw’s validity certificate.
The prize will consist of one year of free Goya olive oil. The winner of the raffle will receive six boxes of GOYA® Extra Virgin Olive Oil at the address specified by the draw organizers. Each box contains 12 500ml bottles (17 FL. OZ) of GOYA® Extra Virgin Olive Oil. Which constitutes a total of 36 liters (1224 FL. OZ) of GOYA® Extra Virgin Olive Oil.
The prize will be sent within a maximum period of one month after the winner’s name is drawn and the winner has communicated their postal address to the organization.
The prize cannot be exchanged for cash or any other prize, nor can it be subject to change or alteration.
The celebration of the draw, as well as the awarding of the prize are subject to current tax regulations.
5.- DISQUALIFICATIONS AND PENALTIES
If it becomes evident that any of the participants do not meet the requirements of the Bases, or the data provided to participate is not valid, their participation will be considered void and they will automatically be excluded from the Promotion, losing all rights to the prizes granted under this Promotion.
6.- PUBLICATION OF COMMENTS OR OPINIONS
No comments or opinions that are considered of inappropriate, offensive, insulting or discriminatory content or that could violate the rights of third parties are allowed. Nor will comments be allowed against a private individual that violate the principles of the right to honor, personal and family privacy and one’s own image. We will not be held responsible for the damages caused by comments made by Participants, or any offence caused by other Participants at any time in the Promotion.
Participation in the present Promotion, as well as the publication of comments made by Participants on the post, may not under any circumstances infringe on the Instagram Community Rules or the Instagram Terms of Use.
7.- DISCLAIMER
By way of example, but not limited to this, we are not responsible for any losses, thefts, delays or any other circumstance attributable to third parties that may affect the implementation of this Promotion, nor are we responsible for the Participant’s use of the prize obtained from this Promotion.
We do not assume responsibility in cases of force majeure or unforeseen circumstances that may impede the realization of the Promotion or the total or partial enjoyment of the prize.
8.- PROTECTION OF PERSONAL DATA
In accordance with the provisions of the General Data Protection Regulations, each participant that accepts these Legal Bases consents that their personal data will be incorporated into a file, and the ownership thereof, as well as the dissemination and publication of their results, and delivery process of the prize, in order to manage the draw.
We inform you that you can exercise your rights of Access, Rectification, Suppression, Opposition, Limitation of processing, Transferability, omitting and to not be the subject of automated individual decisions by sending a letter addressed to the following address: Goya en España SAU Ctra. 9.- CHANGES AND ACCEPTANCE
We reserve the right to modify or expand these promotional bases, to the extent that it does not prejudice or impair the rights of the Participants in the Promotion.
The mere fact of participating in the prize draw implies that the user fully accepts these terms and conditions. Likewise, participation in a draw of this nature implies acceptance of the rules of the Instagram social network through which the draw is implemented.
10.- APPLICABLE LEGISLATION AND JURISDICTION
These legal bases will be governed in accordance with Spanish law. The Courts and Tribunals of the participants’ city of residence will be able to resolve any claim or controversy that may arise in relation to the validity, interpretation or fulfillment of these bases.
